This Policy applies as between you, the User of this Website and Synerise the owner of this Website. This Policy applies to our use of any and all Data collected by us in relation to your use of the Website and any Services or Systems therein. Synerise is the data controller of the User’s Data.

1. Definitions and Interpretation

In this Policy the following terms shall have the following meanings:
"Account": means collectively the personal information and credentials used by Users to access Content and / or any communications System on the Website;
"Content": means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Website or Services, including digital content in the meaning of the Act of 30 May 2014 on consumer rights;
"Cookie": means a small text file placed on your computer by Synerise when you visit certain parts of this Website. This allows us to identify recurring visitors and to analyse their browsing habits within the Website.
"Data": means collectively all information that you submit to the Website (including personal data). This includes, but is not limited to, Account details and information submitted using any of our Services or Systems;
“GDPR” means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (OJ L 119)
"We/Us/Our" or "Synerise": means Synerise S.A. with registered office in Kraków, Zablocie 43b, email address office@synerise.com, entered in the Register of Businesses of the National Court Register by the District Court for Kraków-Śródmieście in Kraków, 11th Commercial Division of the National Court Register under number 0000468034, holding NIP 679 309 32 92 and REGON 122880133;
"Services": means collectively any facilities, Content, tools, services or information that Synerise makes available through the Website either now or in the future, specifically use of the Synerise proprietary e-learning platform (“Synerise Academy”);
"Systems": means any online communications infrastructure that Synerise makes available through the Website either now or in the future. This includes, but is not limited to web-based email, message boards, live chat facilities and email links;
“Terms and Conditions” means regulation setting out the terms and conditions for the use of Website and Services and Systems available through it;
"User" / "Users": means any third party that accesses the Website;
"Website": means the website that you are currently using (synerise.learnworlds.com) and any sub-domains of this site unless expressly excluded by their own terms and conditions.

2. Data Collected

Without limitation, any of the following Data may be collected:
2.1 identification data such as: name, surname;
2.2 business data such as: job title, represented company, company address;
2.3 contact information such as email addresses;
2.4 demographic information such as language preferences;
2.5 information relating to the use of the Services and the Systems through the Website, such as courses completed, certificates obtained, information on the communication;
2.6 technical data (automatically collected) such as: IP address, web browser type and version, operating system, a list of URLS starting with a referring site, your activity on this Website, and the site you exit to;

3. Our Use of Data

3.1 Any Data you submit will be processed by Synerise to provide Services and Systems through the Website to you.
3.2 Any or all of the Data may be used by us in order to provide you with the best possible service and experience when using our Website. Specifically, Data may be used by us for the following reasons:
• 3.2.1 internal record keeping;
• 3.2.2 improvement of our products / services;
• 3.2.3 transmission by email of promotional materials that may be of interest to you;
• 3.2.4 contact for market research purposes which may be done using email. Such information may be used to customise or update the Website or Services and Systems provided by the Website;
• 3.2.5. conducting statistical and analytical activities regarding the use of Website, Services and Systems;
• 3.2.6. ensuring the IT security of Website and Services and Systems available through it
3.3. In certain situations, arising by law, we may process the Data in order to comply with the legal obligations to which we are subject.
3.4. User’s Data may be subject to profiling to achieve the purposes for which it was collected. However, this data will not be used by Synerise for automatic decision making.
3.5.The legal basis for the processing of your Data is: (a) necessity for the performance of an agreement on the provision of Services and Systems available through Website, that you enter into with us by accepting the Terms and Conditions; (b) necessity for compliance with a legal obligation to which Synerise is subject; (c) necessity for the purposes of the legitimate interests pursued by Synerise such as: direct marketing of our products and services, building positive relations with Users, processing of requests and inquiries addressed to us, improving the efficiency of Website, Services and Systems, ensuring the IT security of Website, Services and Systems; use of possible legal remedies to assert or defend claims related to Website, Services and Systems; (d) in some cases – your consent for Data processing.
3.6. Unless we are obliged or permitted by law to do so, and subject to Clause 4, your Data will not be disclosed to third parties.
3.7. Data is stored securely in accordance with the principles of the GDPR.
3.8. Synerise makes every effort to ensure that all Data is stored for the time necessary to achieve the purposes for which the Data was collected. In particular, Users' Data processed in connection with the use of the Website, Services and Systems will be kept for the period of their provision, and thereafter for the period and to the extent required by law or until the statute of limitations for claims. In the case of processing carried out based on the legitimate interest of Synerise or the consent expressed by the User, Synerise will cease its continuation in the event of the User's effective objection or withdrawal of the User's consent to processing.

4. Third Party Web Sites and Services

4.1. Synerise may, from time to time, employ the services of other parties for dealing with matters that may include, but are not limited to IT tools and services search engine facilities, advertising and marketing. The performance of such services may require Data processing. Any Data used by such parties is used only to the extent required by them to perform the services that Synerise requests. Any use of Data for other purposes is strictly prohibited. Furthermore, any Data that is processed by third parties must be processed within the terms of this Policy and in accordance with the GDPR.
4.2. In some cases, Users’ Data may also be shared with public authorities. This will only be done in cases when we are required to do so by applicable law.
4.3. Users’ Data, to the necessary extent, may be transferred outside the European Economic Area when Synerise uses the services (e.g., IT solutions) provided by data processors in the third countries. In case the transfer of Data will be carried out to a third country that is not covered by a decision of the European Commission to ensure an adequate level of data protection, the transfer will take place with an adequate level of data protection, in particular through the so-called standard contractual clauses issued by the European Commission. 5. Your Right to Withhold Information

5.1 You may access certain areas of the Website without providing any Data at all. However, to use all Services and Systems available on the Website you may be required to submit Account information or other Data.

• 7.1.6. the right to lodge a complaint with the relevant supervisory authority, which in Poland is the President of the Office for Personal Data Protection.

Data security is of great importance to Synerise and to protect your Data we have put in place suitable physical, electronic and managerial procedures to safeguard and secure Data collected online.

9. Changes to this Policy

Synerise reserves the right to change this Privacy policy as we may deem necessary from time to time or as may be required by law. Any changes will be immediately posted on the Website and you are deemed to have accepted the terms of the Policy on your first use of the Website following the alterations
